News, Digital Desk- ( Supreme Court) Landlord and tenant disputes are common, which often reach the courts. Recently, such a "classic" case came before the Supreme Court, which exposed the gross misuse of the judicial process. 

The court used this case as an example of how the legal system can be misused, making it a prime example of improper use of justice.

The tenant paid the fine and the rent for 11 years.

The Supreme Court has punished a tenant for illegal occupation of property for three decades . The court has ordered the tenant to pay a fine of Rs 1 lakh to the landlord and rent at market rate for 11 years. This decision shows the determination of the judiciary to protect property rights.

The classic case of landlord-tenant-

Classic landlord-tenant caseBench Justice Kishan Kaul and R Subhash Reddy said that this case is a 'classic' example of how someone can misuse the judicial process to rob someone of their rights. 

This case is about a shop in Alipur, West Bengal. The Supreme Court (Supreme Court decision) bench ordered that the shop be handed over to the landlord within 15 days of the court order. 

Rent till now will also have to be paid at market rate -

The Supreme Court has ordered a tenant to pay the outstanding market rate rent to the landlord within three months from March 2010. Along with this, a fine of Rs 1 lakh has also been imposed on the tenant for wasting judicial time and unnecessarily dragging the landlord to court.

What was the whole matter? 

The case dates back to 1967, when Labanya Prava Dutta leased out his shop for 21 years. When the lease ended in 1988, the landlord asked the tenant to vacate the shop, but he did not do so. An eviction suit was filed in 1993, which was decided in favour of the landlord in 2005.

After this, the case was filed again in 2009 and dragged on for 12 years. This case was filed by a person named Debashish Sinha who was the nephew of the tenant. 

Debashish claimed that he was also the business partner of the tenant. But the court rejected Debashish's petition and also asked him to pay rent at market rate from March 2020.
