It is a crime to encroach or occupy

It is a crime to illegally occupy or take possession of someone else's property. Often, temporary construction is first made for the purpose of occupying or encroaching upon land and then authority is established over it.

The case is filed under section 441-

Section 441 of the Indian Penal Code (IPC) provides for registration of cases related to possession or encroachment of property or land. 

Section 447 provides for imprisonment and punishment

Under Section 447, a fine is imposed on those who occupy property. There can also be a jail term of three months (property possession punishment).

Control the property -

- If someone takes illegal possession of your property (property possession rules), then you should not be lenient. You should immediately take this complaint to the concerned authorities.

- File a case against the occupant or encroacher in the police station (FIR in property cases). Encroachment can be stopped by filing a petition in the court. The court can also give you compensation. 

- Under rule 1,2 and 3 of Order 39, a claim for damages can be made if someone has caused damage to your property during illegal occupation. After this, you can also get a penalty.

- To avoid dispute, the problem of land encroachment can also be resolved through mutual consent. For this you can choose to do mediation, divide the land, sell the property (tips for selling property) or rent it.
